Why might I have overpaid Stamp Duty?
If you buy a residential property in England, you must pay Stamp Duty Land Tax (SDLT) on purchase prices above certain amounts. SDLT is charged on the total value of the consideration you pay. SDLT is a complex area of tax legislation that is self-assessed, meaning you are responsible for ensuring you correctly calculate the SDLT payable on your purchase. Each property purchase tends to be unique; as a result, miscalculations are common and reliefs can be overlooked, resulting in an overpayment.

Am I eligible to claim?
Many buyers are entitled to reliefs or other factors that can be easily overlooked, which can lead to a miscalculation of the rates applied. This includes if you have:
Bought a property with multiple dwellings (Annex or Outbuilding)
Bought a property with serious defects
Bought a property for the first time
If you or your solicitor calculated the SDLT payable just by using the standard rates of SDLT, you may be owed thousands in overpaid SDLT.

FAQs
Stamp Duty Land Tax (SDLT) – is a tax paid on residential (and non-residential) property transactions, including if you buy land or certain property rights (like leases). The rules for how much SDLT you pay are complicated and depend on the value of the property, where you currently live, if you are buying as an individual or a company, how you plan to use the property, and many other factors. SDLT is calculated on a self-assessment basis and must be paid within 14 days of completion of your purchase.
The deadline is 4 years from the date you purchased the property.
To prepare your claim, we will need some of the documents that your solicitor will have provided to you when you bought the property. This typically includes the original SDLT return that was filed, the sales/purchase contract and the completion statement. Our advisors will provide you with the full details of what we need from you and help you to gather the necessary documentation – we’re with you every step of the way.
Because SDLT calculations are not always standard and depend on a number of factors, such as the value of the property, the exact details and description of your property, etc., every claim is different – which is part of what makes it so easy to overpay!
